1. Acceptance of Terms

Welcome to Fortûn ("we," "our," or "us"). By creating an account, accessing, or using our personal financial planning application and any related services (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Fortûn is a personal financial and retirement planning platform that provides tools for budgeting, debt management, investment tracking, retirement projections (including Monte Carlo simulations), tax estimations, and financial goal tracking. The Service is intended for informational and educational purposes only.

3. No Financial Advice

Fortûn is not a registered investment advisor, financial planner, broker-dealer, tax professional, or attorney. All information, calculations, projections, tools, outputs, and insights provided through the Service are for general informational and educational purposes only and do not constitute financial, investment, tax, legal, or retirement advice.

Monte Carlo simulations, retirement projections, and tax calculations are based on assumptions and inputs you provide. Actual results will vary. You should consult with a qualified licensed professional before making any financial decisions. See our Disclaimer for more details.

The Fortûn Network. The Service may display listings of, and facilitate connections to, third-party financial professionals — including financial advisors, tax accountants, and insurance agents (each, a "Network Professional") — through a feature we call the "Fortûn Network." A Network Professional's appearance on the Service is not an endorsement, recommendation, or representation by Fortûn of their qualifications, quality, or fitness for any purpose. Network Professionals are independent third parties, not employees, agents, partners, or representatives of Fortûn. Any relationship, advice, product, or service you receive from a Network Professional is solely between you and that professional. Fortûn is not a party to any engagement with a Network Professional and assumes no liability or responsibility for any act, omission, advice, outcome, or damage arising from your use of, or reliance on, a Network Professional. You are responsible for evaluating and selecting any professional and for complying with any terms, disclosures, or agreements they provide.

4. Account Registration & Authentication

To use the Service, you must:

• Be at least 18 years of age.
• Provide accurate, complete, and current registration information.
• Maintain the security of your password and account.
• Accept responsibility for all activities that occur under your account.

Single Sign-On (SSO) authentication. Instead of (or alongside) creating a password, you may choose to sign in using a third-party identity provider such as Google, Microsoft, Apple, or Facebook (each, an "SSO Provider"). When you use SSO, we receive only the information the SSO Provider chooses to share (typically your name and email address) and an authentication token — we never receive or store your SSO Provider password. Your use of an SSO Provider is governed by that provider's own terms of service and privacy policy, which you are responsible for reviewing and complying with.

Your responsibility for SSO. You are solely responsible for maintaining the security of your SSO Provider account — including safeguarding its password, enabling two-factor authentication where available, and revoking Fortûn's access through your SSO Provider's settings if you wish to disconnect. If your SSO Provider account is compromised, or if you lose access to it (for example, by closing the account or losing its credentials), you may be unable to access your Fortûn account, and we may be unable to restore access without re-verifying your identity through other means. Fortûn is not liable for any loss arising from a compromise, outage, deactivation, or change at your SSO Provider that affects your ability to sign in.

Account linking. If you create an account with an email and password and later sign in through an SSO Provider using the same email address, the accounts may be linked. You are responsible for ensuring that the email address associated with your account remains under your control.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems.
• Interfere with or disrupt the Service, servers, or networks connected to the Service.
• Use the Service to store or transmit malicious code, viruses, or harmful data.
• Copy, scrape, harvest, reproduce, or redistribute protected Service content or other users’ information without authorization, except as permitted by law or these Terms. You may use and export your own information.
• Upload, submit, or use the Service to reproduce or distribute another person’s copyrighted work or other protected material without their permission or another lawful basis.
• Access, collect, disclose, or use another person’s private financial or personal information without their authorization, including information shared through a household or professional relationship, except as needed for your authorized use of the Service.
• Reverse engineer, decompile, or disassemble the Service except where applicable law permits.
• Copy protected elements of the Service to create a substantially similar product, or use protected Service content to train or improve a competing product or artificial-intelligence model without our written permission.
• Resell, sublicense, lease, or otherwise distribute access to the Service or any of its outputs to third parties.
• Circumvent or attempt to circumvent the Service's billing, subscription, referral, or authentication mechanisms.

6. Third-Party Integrations

The Service may integrate with third-party providers, including Plaid (for linking financial accounts), payment processors (for subscription billing), and the Base44 platform (for infrastructure). You are responsible for reviewing and complying with the terms of service of these third parties. We are not liable for the actions, availability, or data practices of third-party providers.

7. Subscriptions & Billing

Certain features of the Service require a paid subscription ("Fortûn Pro"). By subscribing, you agree to pay the applicable fees on a recurring basis (monthly or annually) until you cancel. You may cancel at any time; access continues until the end of your current billing period. We may change our fees with reasonable notice.

Cancellation & Refunds. You may cancel your subscription at any time through the app or by contacting us. Cancellation takes effect at the end of your current billing period — you will retain access until then. All subscription fees are non-refundable, except where required by applicable law. If you believe you were charged in error, please contact us through the Feedback section within the app within 30 days of the charge for review.

8. Privacy & Your Data

You retain ownership of all financial data and personal information you input into the Service. We process your data solely as necessary to provide and improve the Service. We do not sell your personal data. Your use of the Service is also governed by our Privacy Policy and Data Deletion Policy, which describe how we collect, use, store, and delete your information. By using the Service, you consent to the data practices described in those policies.

Your data is your responsibility. Protecting your data is a shared responsibility. While we employ encryption, access controls, and household-level isolation as described above, you are responsible for: (a) keeping your login credentials and SSO Provider account secure; (b) controlling who you invite to your household (invited collaborators gain access to shared household data); (c) reviewing and approving any AI-suggested categorizations or insights before relying on them; (d) maintaining accurate and complete information in your accounts, goals, and inputs; and (e) promptly notifying us through the Feedback section within the app if you suspect unauthorized access to your account. You accept responsibility for any consequences arising from your failure to meet these responsibilities.

Information you provide to linked services. When you link external accounts (such as through Plaid) or connect third-party tools, the accuracy, completeness, and security of the data held by those third parties is their responsibility, not ours. We display and calculate from the data they provide us, but we cannot guarantee its accuracy or timeliness.

9. Artificial Intelligence & Automated Analysis

The Service includes AI-powered and automated features — such as an AI assistant, automated transaction categorization, merchant-rule detection, spending insights, general financial education and summaries, and retirement/Monte Carlo projections (collectively, "AI Features"). These features analyze the financial and personal information you input — including linked accounts, transactions, budgets, goals, balances, and notes — using machine learning models and large language models to produce personalized outputs, summaries, and suggestions.

How your data is analyzed. To provide and improve the AI Features, your data may be processed by us and by third-party AI, machine-learning, and infrastructure providers (including our cloud and platform providers). This processing may include automated pattern detection, categorization, and generation of insights and responses tailored to your information. We do not sell your personal data, and the automated analysis described here is used solely to deliver and improve the Service for you.

AI outputs are not advice. AI-generated content, categorizations, and projections are informational and educational only, may be incomplete, inaccurate, or biased, and do not constitute financial, investment, tax, legal, or retirement advice. The AI Features do not make automated decisions that produce legal or similarly significant effects concerning you; you retain full control over and responsibility for any actions you take based on their output. You should independently verify AI-generated information and consult a qualified licensed professional before making financial decisions. See our Disclaimer.

By using the Service, you consent to the automated analysis of your data as described in this section and in our Privacy Policy.

10. Copyright & Intellectual Property

Ownership. Fortûn owns or licenses the original software, source code, visual design, text, graphics, logos, and other protected content it provides through the Service. These materials may be protected by applicable copyright, trademark, and other intellectual-property laws. This does not transfer ownership of your data to us, claim ownership of third-party materials, or claim copyright in ideas, financial methods, or facts. © 2026 Fortûn. All rights reserved.

Trademarks. "Fortûn," the Fortûn wordmark and logo, "Fortûn Network," "Five Pillars," and related marks are trademarks of Fortûn. Nothing on the Service grants you any right to use these marks without our prior written consent. All other trademarks, service marks, and trade names are the property of their respective owners.

Your license. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for your own personal financial planning, in accordance with these Terms. You retain ownership of the financial data and information you input into the Service, and grant us a limited license to process that data solely as necessary to provide the Service to you.

Restrictions. Without our prior written permission, you may not reproduce, republish, distribute, sell, or make derivative works from Fortûn’s protected site content, code, or design to create a copy of the Service. This restriction does not prevent you from using or exporting your own data, using material you have rights to use, or exercising rights applicable law protects. All rights not expressly granted in Fortûn’s protected materials are reserved.

11. Non-Competition & Non-Circumvention

You agree that, for so long as you use the Service and thereafter, you will not:

• No competing use. Use the Service, or any data, content, or outputs obtained from it, to develop, build, train, market, or improve any product, service, or artificial-intelligence model that competes with Fortûn.
• No scraping or harvesting. Systematically collect, scrape, or harvest user data, professional listings, or other Service content to use outside the Service or to solicit its users.
• Non-circumvention. Circumvent or attempt to circumvent the Service's billing, subscription, referral, or authentication mechanisms — including sharing accounts, abusing referral or trial offers, or using the Service without paying applicable fees.
• Non-solicitation of users. Use the Service to solicit, recruit, or divert other users away from Fortûn for the purpose of offering them competing products or services, or to facilitate the same on behalf of a third party.

These obligations apply to all users. Additional non-competition, non-solicitation, and non-circumvention obligations apply to Network Professionals and Ambassadors as described in Sections 12 and 13.

12. Network Professionals

Network Professionals (listed in the Fortûn Network) are independent third parties and are not employees, agents, partners, or representatives of Fortûn. A professional's appearance on the Service is not an endorsement. Fortûn is not a party to any engagement between you and a Network Professional and assumes no liability for any act, omission, advice, outcome, or damage arising from that relationship.

Professional obligations. By listing in the Fortûn Network, a Network Professional agrees (a) to use the Service lawfully and in good faith; (b) not to use the Service to harvest, solicit, or recruit other users off-platform for the purpose of evading Fortûn referral or subscription obligations, or to offer competing products or services; and (c) not to circumvent the Service's billing, referral, or listing mechanisms. Any off-platform relationship a Network Professional forms with a user they connected with through Fortûn is solely between them and that user; Fortûn does not control, endorse, or guarantee such relationships.

13. Ambassadors & Partners

Ambassadors and other referral partners ("Ambassadors") distribute referral or promotion codes and may earn commission on qualifying paid conversions, as described in the Service. Ambassadors are independent contractors and are not employees, agents, or legal representatives of Fortûn.

Ambassador obligations. By participating, an Ambassador agrees (a) to comply with all applicable laws, including truth-in-advertising and anti-spam rules; (b) not to use the Service to solicit, recruit, or divert other users to competing products or services; (c) not to circumvent, manipulate, or abuse the referral, discount, or commission systems — including self-referral, fraudulent signups, or creating accounts to generate unearned commissions; (d) not to harvest or scrape user data from the Service; and (e) that referral commissions are earned only on genuine paid conversions within the applicable commission window, and may be revoked, clawed back, or withheld for fraudulent or non-compliant activity. Fortûn may suspend or remove an Ambassador at its sole discretion.

14. DMCA / Copyright Infringement Notice

We respect the intellectual-property rights of others and expect users to do the same. If you believe that content on the Service infringes a copyright you own or control, you may submit a notice under the Digital Millennium Copyright Act (DMCA) by contacting us through the Feedback section within the app with the subject line "DMCA Notice." Your notice should include: (a) identification of the copyrighted work you claim has been infringed; (b) identification of the allegedly infringing material and its location on the Service; (c) your contact information; (d) a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. We will review and respond to valid notices in accordance with applicable law.

15. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that calculations or projections will be accurate or complete.

16. Limitation of Liability

To the maximum extent permitted by law, Fortûn and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

17. Indemnification

You agree to indemnify and hold harmless Fortûn and its affiliates from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

18. Termination

You may deactivate your account at any time. We may suspend or terminate your access to the Service at our sole discretion, with or without cause and with or without notice. Upon termination, all licenses granted to you cease immediately. See our Data Deletion Policy for information on how we handle your data after termination.

19. Changes to These Terms

We may update these Terms from time to time. We will notify registered users of significant changes via email or an in-app notice. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America and the state in which Fortûn operates, without regard to conflict of law principles. Fortûn is created and operated in the United States. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts having jurisdiction in the United States.
